L.A. Looks To Make Condom Use Mandatory

Earlier in the month the Los Angeles city council voted unanimously to instruct the city’s attorney to investigate mandatory condom use in porn films. The motion was brought about last December and if it is passed it will ruin porn as we know it today. The motion would require production companies to instruct performers to wear condoms and if they do not comply the company does not receive its film permit. Currently federal law only requires “barrier protection” from bodily fluids and even the government says that they don’t have the manpower to actively enforce that rule. Frankly I’m surprised federal agents aren’t signing up by the bus load to inspect performers use of “barriers.”

The city attorney has 45 days, starting February 4th, to make a decision on the matter. The AIDS Healthcare Foundation(AHF) which is notorious for trying to shut down porn companies who do not comply with their stance of “condoms only” applauded the decision.

“We commend council member Rosendahl and the entire city council for their unanimous vote in favor of this legal study to explore making adult film permits conditional on the use of condoms in adult films.”
The foundation says that porn companies think they’re above the law as California’s existing laws require condoms to be used in adult films.

The sale of pornographic material is a multi billion dollar industry worldwide and they pay an incredible amount in taxes here in the United States. Trying to force condom use in an industry where fantasy prevails could have disastrous effects on the industry itself. I use condoms all the time however I don’t care to see them used in the porn I watch. Its not that its overly distracting but it just comes down to why? Performers are employees and just like every other person who signs up for a particular job they’re aware of what their job entitles. STD checks are mandatory in the industry and performers cannot be in a film without proof of recent testing. Contrary to what the AHF likes to believe porn performers are not the leading cause of AIDS or STD’s in this country nor does porn shape our beliefs around practicing safe sex. If porn was actually influencing if we are practicing safe sex or not then everyone would get an STD test 30 days prior to having sex but none of us do.

Yes mandating condom use will help prevent the several performers who slip through the cracks but again why are we forcing the industry itself to adapt to new rules when the Government admits it isn’t doing its job? If anything the Federal Government needs to get off its ass and conduct the proper inspections that are mandated by law. It is just like the outcry for new gun control. Rules are already in place but no one is ensuring they’re being followed and so people like AHF think that it’s more logical to petition the company to change instead of forcing the government to their job. This is America and if porn companies and performers do not want to wear condoms and their partner on screen is fine with it then let them fuck without one on.

    This is an interesting development in the porn industry. I wonder if this may cause some porn companies to relocate to Florida. I hope that happens because the government continues to set rules on matters that are none of their business. And isn’t California super broke?

    If the government wanted to legalize porn for 16 through 18 year olds and condoms had to be worn in those films – then I would support the change. That would actually be a positive change that would influence young people.

      You’d think with California’s budget problems that they’d want to do everything in their power not to lose the porn industry but yet again logic does not prevail. It would be interesting if they moved their industry to Miami although Florida is considerably more conservative so It would only be a matter of time before all of the oldies waiting to die down there throw a fit.

    There are some porn companies in Florida. Tori Black did her first films there. However, you are right the old people would probably outlaw any new adult film companies from relocating to the Sunshine State. Isn’t Florida broke too?

    The production of adult material is only legal in one state…California.

    The production of adult material is legal in California due to a precedent created by a 1988 decision of the California Supreme Court (California vs. Freeman). As a result of that decision, California became the FIRST AND ONLY state where a person can be legally hired to have sex for the purpose of making Adult Material. However, producers are still required to obtain permits before starting any such production. NO OTHER STATE HAS SUCH A PRECEDENT therefore production in any other State is, and will remain, ILLEGAL!

    However, it is believed that New Hampshire will soon join California.

    Porn companies in CA know this and are hesitant about moving out, or they would have done it a long time ago.

    Testing does not prevent infections (why do people keep forgetting this?) porn performers are constantly infected and a simple piece of rubber or latex can reduce the risk of STI and HIV by 80-95% . testing also assume performers don’t have unprotected sex before the results come back. Even then many companies still let people work if they have diseases, they industry is largely corrupt.

    Its great that you practice safe sex but its really selfish that people don’t like seeing it in porn. Why do porn performers have to constantly risk their health (and in the case of HIV their lives) just for the ‘viewing experience’?

    As for the poor porn industry losing money, I don’t care too bad, work place health and safety is more important. Lets face it they don’t want to pay for condoms (and lubrication). If the industry is so creative why don’t they fetishize condoms or collaborate with condom brands and do some tie in with condom companies (show the brand in the video and put adverts on the sites) greedy bastards will make money and promote safe sex.

      While testing does not prevent infection it does detect it and that bars you from working in the industry. Doing the testing can reduce the risk of infection by up to 90% with the exception being those who choose to have unsafe sex just before shooting. Every mulitbillion dollar industry is corrupt but we must remember that performers are people.

      Those people choose to work with the companies that do shoots with or without condoms. They also choose, typically, what can happen during a shoot with regards to bodily fluids and penetration with or without a condom. The joy of being an American is that you have a choice to quit or go somewhere else.

A soldier can’t honestly tell me that he joined the army and had no clue he could die as a result. The same rationale applies for the porn industry. When you’re having sex on that regular of a basis the risk of contracting an infection is dramatically increased even with the application of a condom. These performers know the risk and choose to take it. They’re responsible for their health and the partner they’re having sex with.

      The industry shouldn’t have to pay for condoms and lubrication when the law only states that they have to go so far and currently that is routine testing. It’s a business. Ford wouldn’t have air bags as a mandatory feature unless it was the law and if you don’t believe me then look at some of the cars abroad.

      In the end it comes down to the employee and their hasn’t been an outcry for condoms in the industry by a performer who hasn’t taken unnecessary risk on their own behalf. If the performers feel that they’re being victimized and used for the ‘viewing experience’ then it is ultimately them who will end up changing the industry.
